WHERE IS IT PROHIBITED TO SMOKE SINCE JANUARY 2, 2011 In order to answer all of your questions about the smoke-free law, here’s a short summary of the places that you can and cannot smoke since January 2, 2011 . Hospitality Industry It is not permitted to smoke in any hospitality establishment. This affects bars, cafeterias, restaurants, pubs, discos, bingo halls, gambling rooms, etc. All of these places should be free of secondhand smoke. Patios of Hospitality Industry Businesses It is only allowed to smoke on patios that are not covered, or that have a maximum of 2 walls. If the patio is completely covered, smoking is prohibited. WEDDINGS It is prohibited to smoke at weddings, since smoking in hospitality businesses is totally prohibited. CULINARY COMPANIES, TXOKOS In closed Indoor spaces that are for collective use, whether or not it’s public or private, it’s completely prohibited to smoke. IN THE VICINITY OF HOSPITALS It’s prohibited to smoke on the campus of any hospital, including outdoor areas. This means it is not possible to smoke at the entrance or exit doors, nor the parking lots or any other outdoor areas, so smokers must leave the campus if they wish to smoke. In psychiatric centers of medium or long-term stays, it is permitted to smoke in designated outdoor areas, and in rooms dedicated to smoking which use their own ventilation system. In senior centers or handicapped centers, it is permitted to smoke in rooms that have independent ventilation, reserved only for the residents of the centers. PARKS AND SCHOOLS It’s not permitted to smoke in outdoor areas that have playground equipment or designated areas for minors. It’s also not permitted to smoke in school zones. This is for the health of the children. AIRPORTS There are no designated areas to smoke in airports since it is prohibited to smoke indoors. It is only permitted to smoke outside the airport terminal. TAXIS Taxis are a public service in a closed space. It is not permitted to smoke inside the taxi. This was already included in the previous smoke-free law. BUSES AND TRAINS – PLATFORMS The law already prohibited smoking in buses and trains. The new law prohibits smoking on platforms of trains or buses if they are covered or semi-covered. It’s only permitted to smoke in spaces that are completely in open air. HOTELS It’s prohibited to smoke in hotels, with one exception: hotels can reserve 30% of their rooms to be smoking rooms, if and only if they are separated from non-smoking rooms, have the correct signage, and have independent ventilation systems. The hotel personnel cannot enter the smoking rooms while they are occupied to guarantee their right to work in a smoke-free environment. FOOTBALL STADIUMS The new law permits smoking in open-air football stadiums, but if you wish to smoke, please keep in mind the people that surround you, especially if there are minors. BULLFIGHTING RINGS It’s prohibited to smoke in covered bullfighting rings. FRONTONS Since 2005, it has been prohibited to smoke in frontons. STADIUMS AND SPORTS VENUES Just like frontons, it has been prohibited to smoke in stadiums and sports venues since they are closed public places. MOVIE THEATERS, THEATERS, AND AUDITORIUMS It’s prohibited to smoke in movie theaters, theaters, and auditoriums, because they are closed public places. AT WORK Since 2005, it has been prohibited to smoke in workplaces, which includes offices. DOORS AND MULTI-UNIT HOUSING SITES It’s prohibited to smoke in all communal areas of multi-unit housing and any parks associated with those buildings. ELEVATORS It’s prohbited to smoke in elevators, just like the rest of communal closed spaces. AT HOME This is the decision of each individual person. In any case, if you wish to smoke in your house, keep in mind the health of others that live with you, especially kids. |
